The FAA regulates the National Air Space, and everything that operates within it. The UAS (Unmanned Aircraft Systems) industry is growing quickly, and the FAA has established temporary rules to assure UAS operating in the National Air Space are flown in a safe and responsible manner.

It is important that you understand some of the basics of commercial UAS operations to protect your business, employees and property. Following are some important points to consider when considering working with an aerial imaging company:

  • The FAA requires companies engaging in commercial UAS operations to have received an FAA Section 333 Exemption
  • One of the current requirements to receive the FAA Section 333 Exemption is that the drone operator have an FAA Airman Certificate. This is to insure that the operator has the required training of the National Air Space and aviation experience to operate the drone safely and responsibly
  • A company operating UAS for aerial imagery should have the proper liability insurance for commercial UAS activities. To get the proper insurance coverage the UAS operator must have received the FAA Section 333 Exemption
  • You should request a copy of the FAA Section 333 Exemption from the UAS company
  • You should receive a copy of the UAS liability insurance certificate for your protection
  • Be wary of companies that “don’t charge for the aerial image filming, but charge for the editing.” This excuse will not “fly” should there be a rare accident.

Use License:  iMagine Aerial Productions LLC grants a temporary license to clients to use still images and video productions throughout the term the listing agreement.  The temporary use license is implicit upon the uploading of the data to the real estate agent or broker by iMagine Aerial Productions LLC via the internet.  When the property of which the still images portray sells, the listing license automatically expires. Should the listing agreement expire between the Seller and the Real Estate Agent the temporary use license expires.  If the property for which the images were produced is relisted with the previous listing agent a new listing license must be granted.  Perpetual licenses for use of still images and video productions are available, and iMagine Aerial Productions reserves the right to charge for a perpetual use license, transferring the right to use the still images and video productions for purposes of agent promotion.  No other license or transfer of digital image property  is implied by the granting of either a temporary or perpetual use license for by the customer.  iMagine Aerial Productions reserves the right to use its copyrighted material for promotional purposes or resale, or any other purpose it deems necessary.
